Karina’s Law: New Provisions to Protect Survivors of Domestic Violence in Illinois

Effective May 11, 2025, Illinois’ Karina’s Law is in force as a new piece of legislation aimed at strengthening protections for survivors of domestic violence. Named in honor of Karina Gonzalez, the law was enacted to close dangerous gaps in the enforcement of firearm restrictions tied to orders of protection.

Karina and her 15-year-old daughter, Daniela, were tragically killed in 2023 by Karina’s estranged husband, who still had access to guns despite a court-issued order of protection.

Karina’s story is heartbreaking, but her legacy is now shaping the future of domestic violence response in Illinois.

 

What Karina’s Law Does

Karina’s Law (HB4144) enhances the ability of courts and law enforcement to remove firearms from individuals who pose a threat in domestic violence situations. Key provisions include: 
  • Mandatory Firearm Surrender
    Individuals subject to an order of protection must surrender all firearms, and any parts that can be assembled into operable weapons, within 24 hours of being served. (Illinois General Assembly, 2024)
  • Search Warrants for Firearm Seizure
    Judges are now authorized to issue search-and-seizure warrants when there is probable cause that a respondent still has access to weapons and poses an immediate threat to the petitioner.
  • Clearer Law Enforcement Procedures
    The law outlines responsibilities for law enforcement agencies to ensure the timely removal, documentation, and safekeeping of surrendered or seized firearms.

These changes address the most vulnerable period for survivors, immediately after filing for an emergency order of protection, when retaliation by an abuser can escalate dangerously.

Larger Context

From 2019 to 2023, Illinois experienced a 63% increase in domestic violence-related gun deaths. Advocates emphasize that the most dangerous time for victims is immediately after legal action is taken, when firearm removal can be the difference between life and death.

Karina’s law responds to this crisis empowering courts and law enforcement with clearer authority and faster timelines to act.
