The U.S. Supreme Court building’s west façade bears the phrase “Equal Justice Under Law.” Inspired by the ideals from the Fourteenth Amendment and from other Greek roots, we can all agree that this must be the ideal in the American judiciary. Equality and justice are natural law principles that we must abide by and the same will result in egalitarianism and fairness. These principles are to result in completely neutral guiding principles that are to be applied to a case by case analysis.
These guiding principles, however, are only as good as the conduct of the participants in the system. An argument can be made that the application of these principles never results in neutrality because the participants in the system themselves come with certain prejudices and perspectives that result in various interpretations about how these principles are applied. That is to say, while on earth, there is no utopia. If you believe that man is fallen, then until God reigns over all no true justice and perfect equality is ever achieved.
On the other hand, the application of these principles requires certain guiding behaviors and expectations from all to achieve the best outcome. We must teach our children and govern ourselves by the belief that everyone is created equal and take action to implement protections to avoid discrimination. We must, as a nation, value human life and exercise good judgment.
We all agree that the recent words of George Floyd ”I can’t breathe” should have resulted in different behavior. We must unify as to our guiding principles and strive to ensure these principles are employed by everyone. Taking responsibility for actions and implementing integrity in dealing with these matters is imperative. We need to become one United States and figure out reasonable changes to the system which will support the principles of equality and justice for all.
